Mark David Andrews, a British citizen living permanently in Canada, was a law graduate of Oxford University in England. He met all the requirements to practice law in British Columbia under the Barristers and Solicitors Act, except that he was not a Canadian citizen. Andrews brought an action, arguing that this requirement violated one of his rights under the Charter of Rights and Freedoms. His case was dismissed at trial but allowed on appeal to the BC Court of Appeal. The Law Society of British Columbia then appealed to the Supreme Court of Canada. The BC Attorney General indicated that the Canadian citizenship requirement had been included in the Barristers and Solicitors Act for three reasons. First, citizenship ensures a familiarity with Canadian customs and institutions. Second, it implies a commitment to Canadian society. Finally, because lawyers play a fundamental role in the Canadian system of democratic government, they should be Canadian citizens
