COLLEGE Assignment #1: Plaintiff's Claim (15%) FACT SCENARIO: Melanie and Jeffrey McNeil purchased a cottage in Muskoka in the amount of $825,000.00 from Tom Baker on June 27, 2023. The cottage is located at: 3164 Muskoka Rd 1 18 West, Port Carling, Ontario, POB IJO The cottage is liveable and insulted for all-year-round use. Melanie and Jeffrey intended to rent out the cottage for additional income. The closing date of the sale was August 2, 2023. On July 1 1, 2023, Melanie and Jeffrey did a walkthrough of the cottage to take measurements and check for any issues. During their visit, Melanie and Jeffrey discovered the following issues: 1. Leaking faucet in the ensuite bathroom, 2. Broken back patio door, and, 3. A missing chandelier light fixture in the dining room. Melanie and Jeff sent a letter to Tom Baker on the same day of their visit noting the deficiencies. Tom confirmed on July 12, 2023, the issues would be resolved before Melanie and Jeff took possession. As a result, the drywall and plumbing needed to be replaced. A new vanity also needed to be purchased and installed. The cost associated with the mould removal, plumbing replacement, and drywall was $3,600.00. While the cost of the new vanity was in the amount of $825.17. The contractor also replaced the back patio door at a cost of $2,700.00. As for the chandelier, Melanie and Jeffrey needed to purchase a new one which cost $4,000.00 with installation. As the closing date for the cottage was August 2, 2023, Melanie and Jeff lined up various renters starting from August 14, 2023, until September 23, 2023 (6 weeks). Each renter reserved for a 1 week stay and they were charging $2,200.00 a week. Given the above issues, Melanie and Jeffrey were unable to accommodate their renters and cancelled their reservations.
