please need help with the discussion below: In my personal opinion there are a lot of potential inherent conflicts that involve police intel gathering. I have found in a lot of different ways that police do in fact ride the line of breaking our constitutional rights when they are trying to find evidence of a crime. Though I think police do some things that everyone might agree on, I do think that police should be given the right to conduct investigations because they are the one with boots on the ground. For example, if there was a crime and there was no time to wait on investigators, the police officers need to be able to conduct at least some type of initial investigation because the sooner the better. With that being said, there needs to be clear suspicion of a crime before police officers do conduct investigations. This is one of the biggest conflicts that do occur. Guilty until proven innocent has become a major issue in our policing nowadays.
A case that did in fact breach civil liberties would be Jennings v. Broome. In this case, there was a breach in privacy which involved emails that were stored by an email provider (Yahoo) in a domestic dispute. Holly Broome (Jennings's daughter-in-law) breached the Stored Communications Act when she logged into Jennings's email after Jennings admitted to falling in love with someone else. The courts ruled that Jennings could make a claim towards Broome under the Stored Communications Act 18 U.S.C. 2701-12. In my opinion, Broome did breach the privacy act and I agree with thr courts in which Jennings could make the privacy breach claim.
