D = Collision with $500 deductible OTC with $500 deductible

Identify what coverage would respond to Bills claim and how much he would recover if anything at all for each of the following scenarios.

  1. Bills parks his car directly under the towns water tower. Unbeknownst to him the town had contracted with Painting is us to paint the water tower that day. The painters had set up their equipment the night before and began to spray the tower sides eventually completing the job in a couple of hours. Bill returned after they had packed up and left to find that his car had minute speckles of paint matching the water towers color all over the exterior of his car! The cost to refinish his car? $3,500. (clear coat)
  2. Paul is a bicycle nut. He was riding his bike whizzing through the streets when he rounded a turn, hit Bills parked car and flew across the cars hood denting it, and breaking his collarbone. His bike was a total loss at $2,500. He was taken by ambulance to a local hospital where his ER bills totaled $3,200, follow up care with his orthopedist $1,000 and loss of earnings of $3,000. The dent in the hood cost $484.00 to repair.

He had overhead lights to illuminate the yard overnight and had a guard dog which roamed freely within the confined space. Two thieves came in the night, drugged the guard dog and hot wired Bills car. They took off. Fortunately Ed the cop was rounding a corner down the street from Larrys and saw the Toyota break through the perimeter gate. He gave chase---the Toyota went out of control and struck a telephone pole totaling it. (Market value $18,400.00)

Fred was a dyed in the wool Democrat and the same could be said for Bill except that he was Republican. The discussion became heated and Bill pulled to the side of the road to meet Freds challenge of fisticuffs. They both got out of the car and went at it with each other. Fred had a broken nose and cuts and bruises on his face while Bill had a fractured jaw. Both went to the hospital ER, Fred had a bill of $2,017 while Bill had one of $4,100.
  5. Bill parked his car in front of his building and went in for the night. The next morning he came out to drive to work and found that the rear end of his vehicle had been caved in by another vehicle, but he had no idea who did it. He called the police and reported the incident and then called his carrier. Total damages to repair $5,045.00
  6. Bill was traveling on US 13 and struck another vehicle in the rear which had been stopped for a red light. Two individuals were hurt and taken to the hospital. The other vehicle had $4,038 worth of damage sustained while Bills car had sustained $1,447.00 worth of damage. Each of the two individuals, as they were being carted away in the ambulance told him they would be suing him for their injuries. They werent kidding. Six months later he received suit papers from each citing $50,000 claim for one and $150,000 for the other. Bill was not injured as a result of this accident.
  7. Bill parked his car illegally. Homer was riding his new two wheel pedal bicycle touring the town. Homer rounded the curve and there was Bill's car! He couldn't swerve to the right or left to avoid impact with the vehicle, he hit it! Homer went flying with his body barely grazing the hood surface! As he cleared the vehicle gravity took hold and he hit the ground with a dull thud. He broke his collar bone. He was taken to the hospital where he incurred $4,200 of ER treatment evaluation and radiology bills. Follow up care was another $1800.00 but he was out of work for 6 weeks incurring a loss of $3,600 in lost earnings.

A green Blazer was in the middle lane of travel just ahead of the front end of John's vehicle when it made an unexpected lane change directly into the path of John's vehicle. Reacting quickly John swerved to the right to avoid impact with the Blazer and was successful in doing so. Unfortunately in doing so, John's vehicle swerved directly in to the guard rail smashing into it and continuing along for about 150' before coming to a stop. John was pushed forward in his seat on impact and then slammed back into his seat as the vehicle came to a violent stop. John was injured going to the hospital and receiving follow up treatments. What steps should John take and within what time sequence along with what claim(s) may he perfect and be compensated for?

Marvin dropped his vehicle off at Fast Eddie's repair shop Fast Eddie told Marvin he could not get to it until the following day but would leave it in his fenced in yard, with a guard dog and overhead all night lights. Fast Eddie did exactly as he told Marvin but nonetheless, at 3:00 am an unknown individual jumped the fence (after drugging the guard dog) and jumped into Marvin's car. The noise of the engine starting up at that hour attracted the lone cop on duty at that time of night and he turned his patrol car around to investigate just when the unknown raced past him going the opposite direction with his headlights out. The cop hit his siren and lights turning his vehicle around to give chase. Just then the driver of Marvin's car panicked, struck a telephone pole coming to a complete stop (totaled). The driver hopped out and made his getaway on foot. He had been wearing gloves and later investigation was unable to establish the identity of the thief.
  10. Bob and Joe were good friends. Most of the time. During election times, Bob was a dyed in the wool Democrat while Joe a republican. En Route to work (they car pooled) they got into an argument about whose candidate was the better person, who had better policies and who would unquestionably be a better incumbent---the argument got heated fast, quick and in a hurry. Joe, who had been driving, pulled over and jumped out of the car---Bob was a hair behind him and they traded punches---Joe had a black eye and concussion while Bob sustained a fractured jaw. Each went to the ER received treatment for their injuries and sought and received follow up care. The fight occurred within an arms length of the vehicle..(Policy described above applies to Joe's car) What claim(s) may be made and what action would be taken on each by the carrier?
