Do we witness the emergence of new criteria of legitimacy limiting the discretionary nature of recognition of a new State? What are those criteria? Discuss the objectives of observance of fundamental human rights by entities which wish to be recognized as States in the light of the EU declarations, first a "Declarations on the Guidelines on the Recognition of New States in Eastern Europe and in the Soviet Union" and a "Declaration on Yugoslavia". Compare and contrast the EU Declarations and the UN conditions for membership with Article 1 of the Montevideo Convention.
