Although John is very intoxicated, he manages to write the following on a Subway napkin which he had in his pocket: "I, John Doe, agree and offer to sell my property on Hilton Head to Jane Roe for $30,000.00. He then gives the napkin to Jane and passes out. He falls off his bar stool, striking his head on the concrete and sustaining a concussion. He is taken to the emergency room by ambulance and is admitted to the hospital. The next day, Jane comes to John's hospital room to tell him that she accepts his offer to buy his Hilton Head property. At the time of her visit, John is sleeping. Jane leaves a check on his bed in the amount of $30,000.00 marked "payment in full for your property on Hilton Head Island." When John wakes up, he is fully recovered from his revelry of the previous evening except for a tremendous headache. He notices the check on his bed, and calls the telephone number on the check. Jane is not home, but John leaves the following message on her telephone answering device: "Thanks for the check. I'll send you a deed for the Marshland Road lot."
