1.)Jack was hired to handle an LMIA for a local employer. After ten weeks, Jack and the employer have not received any communication from Services Canada. Jack sends a fax to the Services Canada office to request the status of the case. Jack receives no reply. Jack decides to contact by phone the Services Canada offices to find out what is going on. Jack identifies himself as the authorized representative; however, the clerk who answers the call advises him that her records are not identifying him as the third-party representative and that she cannot release any information to him. Jack replies that this is totally unacceptable and that it is indicative of their incompetence and she should go find the file, pull out the form to confirm that he is the authorized representative and immediately give him the status of this case. Is this acceptable?

2.)Marsha has been hired to represent Julia on an application for permanent residence under the Semi-Skilled Entry Level nominee program in British Columbia. Although Julia meets the English language benchmark for the program, she does not have strong usage and sometimes struggles with complex written material. Marsha is writing to Julia to provide her with an overview of the process for the application and what she needs to complete the submission. What should Marsha include with her communication?

3.)Saied is setting up his new consultancy now that he has secured his RCIC status and is focusing on the promotional material that he wants to place on his website. Saied has been very involved in politics and has photos of himself with the Minister of Immigration. He wants to include these photos on his website with the following caption, "Hire me as I have great connections and can guarantee positive results." Is this permissible?

4.)Hakob is originally from Armenia, but has resided in Canada for the last 20 years. Hakob has been operating an immigration consultancy firm for 10 years and is primarily focussed on assisting skilled foreign workers secure temporary and permanent status but he is also experienced with students, post graduate work permits as well as transitioning them to PR. Semih is an international student in Canada from Turkey. He is hoping to secure a post-graduate work permit now that he is near graduation. Hakob does not want to represent Semih as he is Turkish. Is it permissible for Hakob to refuse to represent Semih on this basis?

5.)Whitney is a member of the ICCRC and she is not happy about specific decisions made by the regulator. She has started an email campaign to bring these issues to light to all members and is systematically emailing all members with monthly newsletters on her findings and feelings - some of which are quite slanderous and inflammatory. Several members have found these to be a nuisance and they have requested that she not email them anymore. However, Whitney is using an automatic spam program that continues to send the messages to all members of the ICCRC. Is this permissible?
