I briefly discussed this document during the first part of the lecture so it is best to answer these questions as soon as possible after having viewed (or re-viewed) the lecture and read The Act. This exercise is our introduction to the material at hand and will set the stage for more in-depth work to come. In answering the questions, please make sure to cite the specific section and wording of the Act that you deem applicable.

1 You are the attorney for a biologics company. One of the executive officers comes to you and tells you that he has made an agreement with a dog food company to trade a shipment of your company's rabies vaccine for another company's 500 lbs. of dog food. He tells you that he knows the vaccine was prepared during a time your company's license was suspended in is in storage waiting to be destroyed, but that he guarantees it is safe & effective.

a) What will you tell him about the legality of this proposed action?

b) If he argues that you will only be shipping the vaccine to another state and not another country, does that change your answer? If not, why?

c) If he suggests sending the vaccine to Puerto Rico first, where your company has an office, then to your facility in the continental U.S., does that change your answer? If not, why?
