Part 5 - Title : Solutions to the Issues based on Malaysian Labour Laws and Codes.

  • You should refer to the Employment Act 1955, The Industrial Relations Act 1967, the codes imposed by the HR Ministry i.e. the Code of Conduct for Industrial Harmony 1975 (COC) and Code of Practice on the Prevention and Eradication of Sexual Harassment in the Workplace and the Codes of Practice on the Prevention and Eradication of Alcohol and Substance Abuse and use these acts and codes to support your argument (please quote the particular section of the act used to support your argument).
  • You have to analyze which party have complied with /observed the most laws, acts, codes, rules and regulations such as company SOPs, rules and regulation and which party had breached the most laws, acts, together with the sections and subsections, rules and regulations. State each of these compliances and breach in detail.
  • The parties that have followed the most of all the laws, acts codes and procedures should be the parties that should win the case and the one that breached the most should lose the case.
