Florida Statutes Chapter 760 Civil Rights Title XLIV under employment practices does not allow an employer to discriminate against an individual based on "race, color, religion, sex, pregnancy, national origin, age, handicap, or marital status." (Florida Legislature, 2024). A reasonable accommodation is when an employer makes changes during the hiring process or work environment that would allow someone with a disability to be able to perform their task. (Reasonable Accommodations in the Workplace, 2022).

Can a company refuse to hire someone:

  • With a visible tattoo?

Yes, a company can refuse to hire you if you have a visible tattoo. Depending on the company, having a visible tattoo can explicitly go against their employee handbook regarding the attire of an employee especially if it is deemed offensive. The military has a policy that a tattoo cannot be on your head, neck, orother various places.

  • Someone who is transgender?

The military could at one point when the "don't ask, don't tell" policy was in place that impacted the LGBTQ+ community from openly serving. Under the current President, transgender individuals can openly serve in the military. (Pena, 2023).

  • A white person to work in a Chinese restaurant? A black actor to play the role of Amelia Earhart?

Both of these could come under discrimination, but the hiring person can come up with other reasons why they didn't hire a white person or black actor.

Unfortunately, there are a lot of ways a company can choose not to hire or promote a person based on several discriminatory reasons under the guise of lack of qualification. There have been many times in movies or shows where a portrayal of a certain race was played by a white person.
