I think both would more than likely be at fault but since their was eye witnesses that came forward and saidthey saw the car fail to stop at the stop sign before entering the intersection. It can really help C case. So In this situation C could file a negligence tort. Negligence tortsare harms done to people through the failure of another without intention. So in this situation the driver has "three basic affirmative defenses" (Lau & Johnson 2019) which are assumption of risk, contributory/comparative negligence and good samaritan law.
