Novice goes to a golf course on Sunday morning to try out his new set of golf clubs. As he tees off on the first hole, the head of the club flies off and injures a pedestrian walking nearby. Can the injured pedestrian bring an action against Novice? Explain using each element of the tort at issue in your answer.

Yes the pedestrian who was injured can bring an action against the novice.

This is because the novice had aduty of careto ensure that he takes reasonable care to avoid injuring other people and that he uses the club in the right way. However, when he teeing off the head of the club flew off and injured a pedestrian who was walking nearby

The novicebreached his duty of careby failing to ask act reasonably by ensuring that it was before he could tee off. he should also have made sure that he used the proper club which could have prevented the flying off of the head of the club being a novice he should have taken extra care to avoid injuring other people by asking for guidance or being very careful

The otherelement is that an injuryoccurred. the pedestrian who was walking nearby was injured by the head of the club
