Polly: Hello. Well, yes this is Polly Playwright

Peter: Hello Polly. This is Peter Producer

Polly: Yes, Peter, of course, I've heard of you.

Peter: I'm an admirer of your work, Polly. I'd like you to write a TV Western for me. I will pay you $50,000, when you finish it.

Polly: I accept your offer. I will start my research right away.

(Polly researched and writes from June until June the following year.)

Polly: Peter, I completed my TV Western and it is terrific. I will bring it by your office tomorrow and please have the check for $50,000 ready

Peter: Oh Polly, Westerns are out, Science Fiction is in now. I don't need your script anymore I know you worked on hard on it and I feel bad, but why would I pay for something I don't need.

Polly: Well, I don't care if you use it or not, I worked hard on that script and it is very good. I will drop it off as I said, so please have the $50,000 check ready as you promised.

Peter: Too bad you never took Business Law I Polly. If you had you would know that the agreement to pay you $50,000 must have been in writing in order to be enforceable. Since it was not, you cannot enforce the contract against me. If you sue me, you will lose.

Polly: Well I have sued Peter, but his position is a strong one. What two grounds under the Statute of Frauds will he rely on to support his position?

Please post your answers to the following questions:

1. State/explain at least two grounds under the statute of frauds that Peter is relying on for his conclusion.

2. Pretend that you are the court and decide the case on each of those two grounds. Make sure that you tell the reader who will win the case and why. You must have a rationale.
