Here are my notes on the facts: Defendant - James Lee; traveling with his four-year-old son Flying from Miami to Atlanta 20 min. into the flight, Lee's son (Jason) began acting out o Crying o Refusing to stay in his seat o Protested loudly when Lee attempted to restrain him Lee began yelling at Jason - continues yelling for some time - increase in volume and frequency Other passengers became uncomfortable; one passenger asked the flight attendant whether she could do anything to stop the commotion .
