Laude and Pemberton go to Celzone Lodge(motel) at 10:55 night time to satisfy their sexual urges, but at that point, he does not know that Laude is gay. The police report from October 14, 2014, says that it is a hate crime. A hate crime is a criminal conduct against another person because of the social or racial group they believe in. The report from August 24, 2015, says, that while Laude is performing oral sex with the suspect, Pemberton said that he felt a penis. Upon discovering that the victim was gay, Pemberton was shocked and pushed the victim who fell from the bed, but when Laude got back he slapped Pemberton. The suspect says that he retaliated by choking her, which left her unconscious and tried to revive her with water but leaves after finding that there is no water in the bathroom. That night Jennifer Laude is killed brutally as said by Human Rights Lawyer, Harry Roque. Jennifer Laude only slapped the suspect but the suspect saw it as an attack, given that he is a marine soldier being slapped is a little thing compared to their training. On the other hand the defence attorney of Pemberton, attorney Jay Talosa says in a report that the suspect "felt being raped...he was so repulsed and so disgusted because he did not give his consent to allow a man to do that to him". If he was so "disgusted" Pemberton could just leave the victim and run away, but he did the opposite. How could a human being, choke another person because of disgusting? Would he do the same thing to a woman? but because Pemberton is so disgusted that the victim is gay he did it. In the case of Laude, she was killed because of her being a transgender woman
