Jenny takes medicine that seems to control her behavio she has stopped taking it - without telling her mom. r, but Aweek after Jenny stopped taking her medication, she walked up to a neighbor, John, as he walked along the sidewalk near her home. She got in his face and screamed, \"I know you're out to get me and I'm going to get you rst,\" and then she made a threatening gesture and walked on. John, who had no knowledge of Jenny's mental illness, called Renee about Jenny's behavior. Renee told John that while Jenny had made threats before, she didn't think was a problem, and assured him that "this will not happen again.\" John believed Renee, and gured the issue was solved. Based on his discussion with Renee, he did not think Jenny would cause any more problems. Renee questioned Jenny about the incident, and asked if she was taking her medication. When Jenny said she was, Renee thought it was taken care of, and let go at that. About a week later, Jenny saw John raking leaves which had fallen into the street fronting their adjoining homes. Jenny rode her bike toward John very fast, and at the last minute, quickly swerved away. Nonetheless, John jumped aside to avoid a collision and hit his head on the sidewalk, causing injuries. John had to get stitches over his eye, and also suffered a broken index nger. Now John is suing Jenny (and her parents but that is not the issue here). 1. Can John recover against Jenny for a.
