'A.Ifandintheeventthatthepurchaseraforesaidatanytimebeforecompletionmeetshis orherdemise,losescapacity,howsoevercharacterized or,isdeclaredbankrupt,orbeinga companyhasareceiverappointed,iswoundup,deregisteredorgoeseitherintoliquidation or receivership,whethervoluntarily orinvoluntaryand howsoeverdescribed,orinthe event ofbeingatrusteeofaself-managed superannuationfundthatceasesforthwithtobe compliantwiththeprovisionsofthesuperannuationlawsinforcefromtimetotime,thenthe vendormaybyelectronic noticetothepurchasertherebyandforthwithrescind,terminate, causetoberescinded, ceaseandputtoan end thisandeveryclause ofthiscontract, whereupon,heretofore,andnotwithstandingthepriorentryintothiscontractbytheparties, orbytheparties'representativesoragentsdulyauthorized,includingthoughallandany electronic processes,thevendorshallrefundthedepositinamannerthatisconvenientto the vendorbutnotunreasonable,paidtodateandthereafterthepartieswillhavenofurther claimsforloss,damageorotherdetrimentagainsttheotherunderthiscontractandincluding thistermandall its due import.'

Youdonotbelievethatthe specialconditioninsertedbythe vendor's solicitoriseitherwell draftedorbestprotectsyourclient.Youbelieveyour clientisentitledtothe samebenefitof thisclauseifit isinsisted upon bythe vendor's solicitor.
