Complaint 1:

A new team member in sales, Gunkar Singh, has approached you because he feels he is being discriminated against due to the workplace dress code. He has just attended workplace induction, including information about the dress code. It requires staff to wear a uniform, and although all staff are required to wear it, Gunkar has a disability, and there is no flexibility in the code to accommodate his specific requirements. Gunkar has physical restrictions to his shoulders and cannot wear the polo shirt that requires him to put his arms over his head to put it on. He needs clothing that can be fully unbuttoned down the front so he can dress without assistance. In addition, the dress code requires male staff to have short, groomed hair and to be clean-shaven, but Gunkar is from the Sikh religion and does not cut his hair. As part of his faith, he keeps his hair long and is unshaven (kesh) and wears a turban (dastaar) to manage his hair.

Gunkar has come to see you as he is worried that he will lose his job if he does not comply with the strict dress code and says it is not fair to sack him because he can't comply.

Complaint 2:

One of the warehouse team, Joachim Dewitt, a 17-year-old trainee, has been isolating himself at work and is taking a lot of sick days. When confronted by the shift supervisor, Joachim has made allegations about the warehouse manager that he is feeling targeted and is being singled out when work gets behind schedule. The shift supervisor, Alice Johnson, has agreed with Joachim as she has heard the warehouse manager, Jock McTavish barking orders at Joachim to see him react. She heard the manager say he likes to 'bruise' Joachim because he is so young as it is good sport. Alice told Joachim to speak with Jock and tell him to stop. But Joachim feels like he can't do that and has now come to you in tears wanting to resign.

You are to manage the two (2) diversity complaints by referring to your workplace policies on employee grievance and discrimination policies or use the simulated workplace of The Righteous Bean

You are to complete Appendix E - Grievance and Complaint Investigation Report.

You are to address the two (2) diversity complaints by conducting an investigation and recording your findings on the Grievance and Complaints Form. You will use a separate form for each complaint. In writing the report, you will:

  • Record the details of the investigation of the two (2) complaints and make recommendations to address the complaints.
  • Ensure that you use analytical skills to decide on the appropriate application of the diversity policy in a range of complex situations.
  • Ensure you prepare factual and informative documentation to suit the purpose and audience.
  • Ensure that you record investigation findings according to organisational and legislative requirements.
