It provides that workers over the age of 40 years cannot arbitrarily be discriminated against in any employment decisions because of age. This includes hiring, discharge, layoff, promotion, wages and other terms and conditions of employment, referrals by employment agencies, and membership in and activities of unions. The FADA applies to employers with more than 20 employees, and to public and private employers, including state and local governments and their agencies. States individually may have separate laws further protecting workers. The act is administered by the EEOC
