Question:
Q. Sarah has always had a keen interest in one of her friends, John's collection of rare stamps and she had on a number of occasions shown interest in buying some of John's rare African stamps. One fine day John decided to sell off a few of his collectables and a few days later on the 21stof September, 2014, he sent an email to Sarah clearly stating, 'I am willing to sell twenty pages of exclusive African stamps for 2000 pounds and I know you will be pleased that I have finally reached a decision and so don't bother to reply. Come and collect the stamps as soon as you can.'
Sarah on receiving the email was indeed very pleased and she immediately sent a reply to John stating, 'I will not be present in the country for a while but I am more than happy with the price you have offered and do keep the stamps for me until I come and pick them up from you.' However, unfortunately, Sarah' s message never reached John due to a temporary fault in the email server at John's end.
Sarah, after around a monthb , on the 23rd of October,2014, visited john to collect the stamps but was seriously disappointed to learn that john had gave away the stamps to his nephew since according to him. Sarah did not turn up to buy the stamps in time.
Provide an explanation in reference with case law as to whether any binding contract exists between Sarah and john.
