Q1. Anne, Belinda and Charmaine agree to go on a bus tour together, visiting places of interest in the New Territories. The tour is organised by Land Between Tours (LBT). Anne and Belinda book their tickets on-line and, before clicking "Pay Now", they "Confirm" that they have read and understood LBT's terms and conditions. These terms include the following statement: "This contract is made between Land Between Tours (LBT) and you, the customer. LBT accepts no liability for any loss, damage or injury suffered by customers; howsoever caused. This exemption of liability extends to LBT's servants or agents including, but not limited to, our bus drivers." Charmaine is running late and books a ticket ten minutes before departure at LBT's ticket office. After she has paid for, and received, her ticket she is given a "Receipt" which contains the same terms and conditions as Anne and Belinda have seen. On the journey, as the bus nears Shatin, the driver becomes sleepy, temporarily loses control of the bus, and crashes into a tree. Anne is injured by broken glass from a window broken by the tree. Belinda is thrown forward in her seat but is unhurt. However, her new mobile telephone is damaged beyond repair. Charmaine also escapes injury but her new camera is completely destroyed. Anne, Belinda and Charmaine wish to sue either LBT or the driver but seek your advice as to the effect of LBT's exemption clauses on their potential claims. Advise Anne, Belinda and Charmaine
