Procurement is defined by the Public Procurement and Disposal of Public Assets Act, 2003 as the acquisition by purchase, rental, lease, hire purchase, license, tenancy, and franchise or any other contractual means of any types of works, services or supplies or any combination of the above. Private procurement and supplies are governed by the Law of Contract. The law of contract together with the law of sale of goods are two pieces of laws that govern private procurement and supplies. And as one of the requirements of a valid contract, there must be offer and acceptance for a contract to be valid. However, in the modern economy standard form contracts are dominating contracts and in such a situation there is a battle of forms passing between procurement and supplies. In reference to the information above, a) Examine the extent to which public procurement law has contributed to the achievement of value for money and service delivery objectives in Uganda. b) Describe the sets of law that provide the legal framework for procurement and project management operations.
