On 1st October 2008 the property was transferred to Precious's name and Precious immediately gave Marvellous notice that he had to vacate the property, since she and her family wished to move into the house within the next month. Marvellous refused to move out, arguing that the maxim huur gaat voor koop was applicable to the situation and that he therefore had the right to remain in the house until the two-year lease had expired.
