Human Resource Managers work hand in hand with trade unions and need to create amicable relationships to serve the interest of all parties. Define and outline the nature of trade unions in South Africa. (10 marks) 1.2 There are generally imbalances in power and inequalities between the working classes and those who own and control the productive resources. With this in mind, summarise the generalised objectives of trade unions. (8 marks) 1.3 Employers are not forced to engage in collective bargaining with trade unions, however, the Labour Relations Act 66 of 1995, makes provision for organisational rights to registered trade unions. Briefly discuss these rights. (5 marks)

She has been notified by the Financial Manager that Brian, a Chartered Accountant in the accounting department, has been caught pilfering funds from clients investments. Regardless of the severity of the accusation, Leza needs to investigate this claim of misconduct, to ensure that a fair disciplinary process has been followed in terms of the organisation`s Disciplinary Policy. *A Te Roller Required: 2.1 Identify and describe all three possible reasons for terminating the services of an employee by dismissal, in terms of international and South African law. (3 marks) 2.2 Based on the scenario above, after a full investigation, Brian was found guilty of the charges against him. Recommend grounds (a reason) for his dismissal and briefly discuss the primary source of legislation which guides employers who contemplate the dismissal of an employee. (6 marks) 2.3 With reference to the scenario above, provide management of the organisation with an understanding if dismissal will be an appropriate sanction for this case. Provide a reason for your answer. (3 marks)
