(a) The Royal Malaysian Police received an anonymous tip that there would be a demonstration in front of the Indonesian embassy. A few patrol cars were sent to monitor the situation, and several officers were placed in the area. The crowd that gathered in the morning steadily rose up until it was too large for the police to handle. Although the police did react by sending more police officers, by the time they arrived, the crowd that had started to riot had already caused damage to the embassy property and injured some embassy staff. In an attempt to subdue the situation, the Malaysian police had inadvertently caused some injuries to the rioters and citizens in the area. Is Malaysia responsible for the injuries and damages?

(b) Would your answer differ if the injuries had been caused by military personnel that had acted without orders or against the wishes of their commanding officer? Elaborate.

Question 2

(a) Amanda, the wife of an Ambassador in Malaysia, used the Embassy car to pick up her son at the airport. Unfortunately, she accidentally sideswiped a car when she did not stop at the 'Stop' sign before turning. Can she be charged?

(b) Assume that the bag had been opened without authorisation, and illegal drugs were found within. The bag had been carried by Adrian, the son of an Ambassador in Malaysia. He holds an American passport and is a permanent resident in Malaysia. Discuss
