How do you think they ought to be resolved? After reading the whole required materials for this week, I have learned what is the difference between the civil and criminal law systems. Civil law spells out the rights and the duties that exists between individuals and between individuals and their governments while criminal system of law is concerned with the punishment of those who commit crimes. In this particular case about a missing child called Kyron Horman, we can see that both the civil and criminal law systems are presented. The civil law system would be civil proceeding in terms of divorce between Kyron's father and his stepmother. On the other hand, the criminal law system is a criminal proceeding against Terri Horman for the disappearance of her stepson Kyron. Both cases are in process and under investigation. However, in this case, we have the conflicts between civil and criminal systems. For example, criminal nexus to the couple's divorce proceeding is a direct result of a three-year campaign. Then, Kyron's father and his attorney used criminal injury against Terri to finish their divorce proceeding. I mean that Terri Horman's lawyers were trying to obtain information on the ongoing criminal inquiry through the civil proceeding. Also, their civil and criminal processes will take longer because the accused Terri Horman is included in both cases and there is no enough evidence that she is responsible for disappearance of the child. She is in a civil (divorce) procedure with Kyron's father, but also she is one of the suspects in the disappearance of Kyron.
