TV Suju produced a new reality game show called 'Square Game'. All person aged between 20 to 70 years old are invited to play a series of children's games for a chance to win a large cash prize worth RM100 million. Those who agree to join the game must go to the theme park main entrance located at Sejuk Island. Among the participants are Ali and Sebok.

Ali aged 67, was given with a piece of form to sign which is the Game Rules. As Ali unable to read, he asked the organizer what is the form about. They explained to Ali that the form is to get his consent to participate in all games. However, the form provides clearly in red ink that "the organizer will not be liable for any injury or loss suffers while in the theme park and/or while playing the games". Ali signed the form.

Sebok aged 33, a very busy businessman who's highly in debt. He arrived late. By the time he arrived, there is no copy of 'Game Rules' left. The organizer gave him a photocopy of the rule which is not clear and difficult to read due to smaller font size. The form was given to him only after he finished the first game. He noticed that the Game Rules was also hanged at the wall of every game room inside the theme park.

By end of the game, Ali's leg was severely injured while Sebok lost his wallet and credit cards. They approached the organizer to claim for the injury and loss suffered. The organizer denied their claim based on the exclusion clause in the Game Rules.

Discuss whether the exclusion clause is valid or not and whether they can claim for the injury and/or loss suffered?
