Question 1 :

In 2013, A and B was in a relationship. A has agreed to help B by offering a financial help by giving a money from personal loan and credit card to B. The loan and Credit card was registered under A`s name. There is no written agreement was made between both of them. In 2015, A and B has split. Somewhere in June 2016, A are requesting for B to pay back the amount that B used from the personal loan and the credit card. Giving the situation that B has made one time payment on April 2022. In May 2022, A has send a summon to B demanding her to pay the said amount as stated in the summon.

According to the Limitation Act of 1953 of Malaysia, explain the questions below :

Question 1:

1a) Whether or not A will success in his claims and what should he do in order for him to succeed?

2b) Whether A can implement Section 6a under Limitation Act of 1953 onto the case to request for the 6 years timeline to be extend and relate the latend damages towards the situation.

3c) Whether B can strike out the A`s application by using the 6 years of timeline.

Advise B on what she can do in order to avoid the liability. Provide a relevant cases.
