Question 1 Mischa and Grischa were both born in Auckland, New Zealand but in their 20s they immigrated to Australia. Now in their 40s, they have lived in Australia for about 20 years where Mischa worked as a fisherman, Grischa worked as a doctor's receptionist and raised their two sons. Grischa's only living relative was her wealthy 65-year-old mother, Baba who still lives in an apartment in Auckland, New Zealand. Baba greatly missed her grandchildren and wrote to Grischa and Mischa asking them to leave Australia come and live in Auckland New Zealand so she could be close to them and her grandchildren. She said they could live with her for 6 months and then she would purchase them a house in Auckland and pay for all their living expenses until Mischa and Grischa found new jobs in Auckland. So based on Baba's offer, the family decides to see how things go for 6 months rented their house in Australia to tenants for 6 months, quit their jobs and moved to Auckland. The whole family lived in Baba's large apartment for about 3 months while they tried to find a suitable place of their own. Unfortunately, Baba had arguments with the family every day and then at the end of those 3 months threw the whole family out of her apartment and told them she would not buy them a house. The family moved out of Baba's apartment, rented a house in Hunter, a suburb of Auckland. Mischa found a job in a seafood shop and Grischa found work as a waitress in a caf. Advise Mischa and Grischa if they can enforce Baba's promises or not? Question 2 Fischer and Paykel are best friends who are professional chess players who compete in chess games where the winner receives prize money. They orally agree to both enter into the same chess comptions on the understanding that if one of them wins then they will divide the prize money between them. So Fischer pays for both of their entry fees for one chess comptition one week and Paykel pays for both of there entry fees in a different chess competition the following week. They have been doing this lottery together in this way for about 2 years. One week, Fischer purchases the entry fees in just his own name, instead of purchasing the ticket in both his and Paykels names. Fischer wins the chess compettion and the following day, Boris Johnson a representative from the chess association finds Fischer address using the entry fee details and presents a cheque made out to Fischer for winning the chess competion in the sum of $50,000 dollars. Paykel then contacts Fischer to ask for his share of the winnings. But Fischer gets greedy and says that he is under no obligation to share the winnings with Paykel. Advise Paykel as to whether there is a binding contract between himself and Fischer or not?
