Question 1 - Offer and Acceptance
Major Talent Group, a marketing organisation, undertook a widespread marketing campaign for its client, popular music group, Urban Elves. In its online advertisements, Major Talent Group stated as follows:
"Attention all Australian Urban Elves Fans
Register for concert pre-sale to win flights, accommodation and a VIP limo party experience with the Urban Elves. The more people you share this competition link with, the more entries to win, you will receive."
Isabella is an avid Urban Elves fan. When she saw this advertisement, she immediately reached out to 80 people and shared the competition link as instructed, placing her in the top 10 percent of potential competition winners. Three weeks later, Isabella received an email from Major Talent Group informing her that she won the VIP experience. Isabella waited in anticipation for further correspondence with arrangements for the VIP experience but heard nothing further. Two months later, Isabella emailed Major Talent Group enquiring when the event would take place but she was informed that given the recent COVID 19 restrictions, Major Talent Group had decided to cancel the event and apologised to Isabella that her prize would not be awarded to her.
Analyse the communication between Major Talent Group and Isabella and advise them of their individual contractual liabilities.
