Question 1.4 Using examples, explain what is meant by 'delegated' or 'subordinate legislation'. Why is this type of legislation particularly important in ensuing clients are properly advised about business compliance? Australia's legal system is based on the 'ruie of law' central to which is natural justice. How is natural justice incorporated into our court system? Delegated legislation is where parliament delegates their legislationmaking powers to an executive body. This results in the regulation of government departments. statutory bodies and the by-laws of local councils. Regulations are extremely im portant to business com piiance because they are often the part of legisiation which gives the fine and concrete details to the general principles set out in the relevant act and maybe subject to frequent amendment. Delegated legislation can be made by those who have the technical expertise and professional knowledge that the parliament lacks. For example, the regulation which accom pany Sate work, health and safety acts set out the fine detail of conduct required to keep workers safe. Obviously what is required to keep an accountant working in an office safe is very different from what is required to keep a miner or nurse or a kitchen-hand safe
