QUESTION 15 (20 marks) 600 words.

Andrew is an accountant. He agrees with George, a garage proprietor, that he will assist George with his annual tax return if George will service his car for him. He also agrees with Stella, a fashion designer, that he will advise Stella on the installation of a computerised financial management system if Stella in return, will design and make a suit for Andrew's daughter, Diana. Andrew assists George, but because the service was not done correctly the car breaks down when Andrew is on the way to an important meeting with a client. Andrew is very late for this meeting and as a result the client switches his work, worth some 25,000 per annum, to another accountant. In addition Andrew incurs 500 costs putting right the defective service.

Andrew advises Stella, but she refuses to carry out her side of the agreement. Diana is very anxious to have the suit designed and made by Stella because of her reputation for innovative fashion.

Advise Andrew and Diana as to the nature of the contractual remedies, if any, which may be available to them.
