Question 2 [10 marks] Read the following facts CAREFULLY then answer questions 1 to 10 which follow. The people involved Dimitri is the owner of a chairlift which is located at the ski fields in Kosciuszko, NSW Tomas is a student; he works for Dimitri two days a week operating the chairlift Margot is a ballet dancer who is on a two week skiing holiday in Kosciuszko The events One morning when Tomas arrives to start work; he soon notices that the chairlift is not functioning properly and could be dangerous 2 Tomas contacts Dimitri by phone, explains the problem and suggests the chairlift be closed until it is checked out 3 Dimitri does not want to lose the income from closing the chairlift so he instructs Tomas to keep it operating until he can contact an engineer to come and check the chairlift later in the day 4 Tomas is not happy about doing this but he does not want to lose his job so he follows Dimitri's instructions and keeps the chairlift operating 5 Margot arrives at the chairlift and joins a queue of skiers waiting to use it 6 While Margot is waiting she sees the chairlift stop suddenly with a jerk several times then start moving again; on one occasion the jerk is so severe a passenger is almost thrown out of the chair in which she is seated 7 Margot is worried about this but is keen to get started on a day's skiing so she boards the chairlift when her turn comes The chairlift moves off but Margot soon finds she is uncomfortably seated so she unlocks the safety bar to adjust her seating position 9 About 30 seconds later the chairlift violently jerks to a stop; Margot is thrown out because her safety bar is not in place and falls 4 metres 10 Margot suffers injury to her hip and leg which will take months to heal; she incurs medical costs and has to abandon the remaining 10 days of her skiing holiday 11 Margot also has to give up a planned scholarship to study ballet with a world class ballet school in Moscow 12 Margot now wishes to sue Tomas for compensation for a. her medical expenses, b. the money she paid in advance for the now-abandoned ski holiday C. her lost scholarship
