Patrick was a pupil in Hello Minnie Kindergarten. One day, when Patrick was playing in the playground with his classmates, a workman Chan was repairing the hot water pump nearby. Unfortunately, Chan accidently broke the pump. A lot of hot water splashed over the adjacent playground and hurt Patrick. Patrick was seriously injured and had to stay in the hospital for two months. Chan was employed by Hang Fok Limited to do the repair works in the kindergarten. Before commencement of the works, Hang Fok Limited had already warned him that there was high risk of accidental leakage of hot water because of the poor condition of the pump.

Required:

(2a) Discuss whether Chan would be liable for Patrick's injury on the ground of negligence in tort. You are required to cite a relevant case to support your answer. (19 marks)

(2b) Discuss whether Hang Fok Limited is vicariously liable for the injury of Patrick caused by Chan's negligence. (6 marks)

Due to the need for a major restructuring, its board of directors had made several moves including downsizing the staff force and closing down some selected stores recently. Jacky had worked in ABC as a purchasing manager for five years and was responsible for purchasing gaming computers and accessories for ABC. Jacky regularly purchased from a number of suppliers for gaming computers and accessories including a major supplier Fancy Electronics Ltd. (FEL). Unfortunately, ABC had laid off several personnel including Jacky in January 2022 due to the restructuring. However, in March 2022, Jacky still made another purchase of some gaming accessories from FEL in the name of ABC. Shortly after, ABC received an invoice from FEL demanding for payment in respect of Jacky's purchase in March 2022.

Required:

(3a) Explain whether ABC would be legally bound by the purchase made by Jacky with FEL in March 2022 under the agency law. You are required to cite a relevant case to support your answer. (11 marks)

(3b) Would your answer in 3(a) be different if FEL already learnt that Jacky no longer worked in ABC when he made the purchase in March 2022? Explain. (4 marks)
