Question 2: [3 marks} Much of the Shire of Ti-Trees on the North Coast ct New South Wales consists ct unspoilt coastal rainforest. The Shire Council is entitled to promulgate regulations under the Local Covemment Act which apply to their Council area and which are consistent with the relevant Local Environment Plan. The Shire Council consisting largely of members who are environmentalists have curtailed development in some villages within the shire. Regulations have been made regarding the sale of land owned by the Shire of Ti- Tree. Regulation B provides: Any person who purchases land at an auction of land owned by the Shire shall be registered at the Shire and shall not be permitted to bid at any other auction of land owned by the Shire during a period of twelve months after the said purchase. The purpose of this regulation was to prevent developers from buying numerous parcels of land in the Shire. Len Booker is a developer and his secretary tells him that he can buy as much land as he wants by simply incorporating a new company before each auction. Advise Len Booker whether the council can bring action against him for the incorporation of a company to bid at more than one auction to purchase additional land
