Question 2

The next day at the salon, Cedric dyed Michelle's hair with a product manufactured by the Best Hair Company (BHC). It was not a product that he normally used.

According to the product instructions on the label, the hair dye was to be left on the hair for 20 minutes. Cedric was very busy and was very tired from staying up late last night to watch the entire 6th season of Game of Thrones. Cedric also forgot to wear his reading glasses that day.

Cedric did not read the label instructions of the hair dye. He assumed the product was the same as the products he normally used. He put the hair dye on Michelle and left it on for 2 hours! Michelle's hair fell out the next day.

Would Michelle succeed in a claim of negligence against Cedric? And why? Give reasons for your claims.

Hint:

Use the same process as you used in Question 1. But think about who Michelle is suing here - what is their relationship? Make sure to focus on Element 2 in your discussion for this question.

Duty of care

(The plaintiff and defendant are a hairdresser and customer, therefore there is no established category of a duty of care. We apply the legal neighbour test from Donoghue v Stevenson (Donoghue v Stevenson [1932] AC 562), and we also consider the salient features (whether the defendant was relying on the defendant/the defendant was in a controlling position (Tame v NSW (2002) 211 CLR 317)).
