Mary had to go to the party because her employer, USP, fired anyone who did not attend. May drove a USP truck to the party because her car was broken. USP allowed and encouraged their drivers to take USP trucks home since increased visibility leads to increased advertising. The President of USP walked Mary to the truck at the end of the party, and then made a pass at her, promising her a promotion if she would kiss him. Mary refused, but he tried to kiss her anyway, missing her mouth but pecking her cheek. On the way home, Mary decided to stop by her ex-boyfriend's house. He was out in the street with his new girlfriend. As a joke, Mary revved up the truck engine and aimed her truck at them. She, of course, was just kidding and did not mean them any harm. Nonetheless, they looked up when the heard the truck, screamed and jumped out of the way. Because they moved, Mary's truck accidentally brushed up against the new girlfriend, although she only had minor physical injuries. Due to a slight miscalculation on Mary's part, the truck jumped the curb and ran over the next door neighbor's rose garden. Can anyone be sued in civil court for a tort? After Mary's Valentine day spree, she needed money to pay a lawyer. She decided that it was all her ex-boyfriend's fault, so she drove over to his house first thing Monday morning to make him give her some cash. He was not home, but Mary knew that the lock on the sliding glass door was broken, so she went around back, opened the door and entered the house. She found $250.00 and his checkbook on his dresser and took that. While looking around she noticed lots of pictures of his new girlfriend and none of her. She grabbed all the pictures put them in a trashcan and set them on fire. Unfortunately th trashcan was plastic and started to melt. Mary panicked and ran out of the back door as the flames caught the curtains and wall on fire.
On her way to work, she wrote herself a $500.00 check from his account and cashed it at the bank. She knew she still needed more money. That night after everyone had left the office she snuck into the Accounting Department. One of her friends had told her he always used his birthday as his password. Mary was so happy she was able to access USP's bank account using his password. She transferred $5,000.00 to her checking account fully intending to pay USP back.
