Chantelle and Dave both work at Keel and Grimauld Attorneys. They are both avid basketball players. They both belong to their local league, the Jumping Jacks.
Chantelle promises to be a very good basketball player and has aspirations for a professional career. She does not intend to stay in law and hopes to be picked up by a scout at the Championship game.
On the day of the championship game Chantelle slipped within the first 6 minutes of being on the court and broke her ankle. This injury will keep her out for the rest of the season. Chantelle is beyond upset as a scout was coming to the Championship game and this game could have meant big things for her. Upon investigation it is discovered the gym where the Jumping Jacks played has recently had their floor buffed by Polish R Us. The buffing was done by Peter, an apprentice who made the floor much too smooth and more shiny than it needed to be resulting in an overly slippery floor. No supervisor was present and no training was given to Peter. Peter has since been fired. Polish R Us claim that he is not competent and unable to do his job efficiently.
- Peter has come to you for advice. He claims that he is not responsible for Chantelle's injury and should not be held liable. He is also very upset as when he took the job with Polish R Us he was promised on the ground training and supervision. In the advertisement for the position, it said the Polish R Us will train the successful applicant. In the interview, Michelle, the HR rep, told Peter that he would receive four weeks of training before being sent out to do job on his own.Advise Peter.
- Chantelle would like to bring a claim against Polish R Us with regard to he broken ankle. Peter is very worried that he will be held liable.Advise Peter.
- Dave has also not had a very good week. While heading into the office on the Monday morning before the game, Dave has slipped at the entrance to the building and broken his ankle.It was a very rainy day outside and everyone was trekking into the building with wet slippery shoes. No mat had been placed out the from of the gym and no 'Caution Wet Floor' sign was visible. No occupational Health and Safety office is on the staff.Advise Keel and Grimauld Attorneys.
