Question 4 (20 marks) You were auditing a garment factory at Selangor of Malaysia against the requirements of Social Accountability 8000 (SA 8000, as attached in Appendix III on pages 10 - 18). During the audit, you noticed the following situations. For each of the situations below, determine whether there was any non-conformity. If there was any non-conformity, specify the evidence observed and the relevant requirement(s) of SA 8000 together with the clause number. Otherwise explain the reason why it was insufficient to raise non-conformity and propose any preventive action for improvement. (a) During an interview with a newly joined staff in the production department, she showed you her identification card and confirmed that she was not a child labour. As her job was introduced by an agent, you then asked whether the agent asked her to pay any referral fee. She replied that the agent did ask for referral fee but the factory had paid for her. However, the factory compulsorily required workers to wear uniform for a better image, she had thus paid US$20 to the factory for two sets of uniform before she signed the employment contract. She also complained the factory did not provide uniform washing service and she needed to wash the used uniform at the dormitory by her own, [10 marks) (b) You asked the Top Management whether any health and safety committee was set up. He replied, "Yes, we do. We have set up a Health and Safety (H&S) Committee last year, which composes of one worker representative per each department and a total of ten members. Besides, the Committee has established a series H&S requirements according to SA 8000 this year." You then asked who was responsible to the implementation of the H&S requirements. The Top Management said, "The Chairman of the H&S Committee is responsible for that, who has been elected among the members of the H&S Committee. I will introduce him to you later, whom is now working as an ironing worker in the packing section." You then interviewed with the Chairman of the H&S Committee and found he is knowledgeable about the H&S requirements implemented. [10 marks)
