X-Treme! Sports is the leading outdoor sports shop in Sydney. One day, Paul entered X-Treme! Sports and said to the sales person, "Look, I am planning on going climbing in the Himalayas and I need a suitable sleeping bag. The bag needs to be water proof and also very warm, because the weather overnight sometimes drops to around minus 30 degrees Celsius. What have you got that's suitable?" The sales person took Paul to a section of the store where they kept the mountaineering equipment and showed him a number of sleeping bags that would suit Paul's needs. Paul selected one of the suggested sleeping bags and bought it, paying $850. Unfortunately for Paul, when he went mountain climbing in the Himalayas, on his first night he suffered frost-bite and had to return home because the sleeping bag was totally inadequate for freezing temperatures. Paul wants to sue X-Treme! Sports under the ACL. Advise Paul
