Question 4 Norman works part time in "Super Savings", a local grocery store. His job scope is to stack and replenish products on the shelves during the night shift. However, on this occasion, he is asked by the store manager, Benny to work in the morning shift.

He arrives at the store at 6.30am, waiting for Benny to turn up. Benny does not turn up at 7am. Norman telephones Benny and is told that Benny is running late as he has been delayed by a traffic jam caused by a road accident on his way to the store. Benny tells Norman the access code for the door and asks Norman to open up the store. Norman punches in the access code and opens the store at 7.10am.

Norman is a little surprised to find that the store is not very tidy. There are opened boxes and trollies left in the middle of the store. Some of the boxes are stacked so high that they are taller than Norman. Norman then proceeds to locate the light switches in order to turn on all the lights in the store.

At this moment, an old lady, Mrs Lee enters the store. Mrs Lee is a regular customer and is fairly familiar with the layout of the store. However, as the light in the particular section of the store is not yet switched on, she fails to detect a tower of boxes in front of her. Mrs Lee crashes into the boxes and they topple on her.

Mrs Lee suffers a fracture in her right arm. When she is being hospitalized, the doctors advise her to stay in bed under "Complete Rest in Bed". She refuses to use a bed pan and insists on going to the toilet by herself. She falls down in the toilet and incurs further injuries to her left arm and left leg.

Discuss and conclude if Mrs Lee can succeed in a negligence claim against Super Savings for the injuries sustained.
