Question: Dwen, a motor vehicle spare parts sales agent, always deals with Royston without using the name of Fran, his principal. However, Royston knew that Dwen was acting on Fran's behalf. On March 13, 2021, Fran terminated his agency relationship with Dwen. Nevertheless, Dwen continued doing business with Royston, supplying him with motor vehicle spare parts who was unaware of the termination. It was only on March 30, 2021, that Royston learned that Dwen was no longer Fran's agent. Royston demanded Fran the payment for the price of motor vehicle spare parts which the former had delivered to Dwen between 14 March 2021 till 29 March 2021. Nonetheless, Fran refused to pay, claiming that Dwen was no longer his agent effective on 13 March 2021. Advise Royston as to his legal rights.
