QUESTION EITHER The fundamental contradiction in contract law today is trying to strike a balance between unacceptable excesses of freedom of contract and the desire to permit individuals the dignity and autonomy of regulating their own lives, premised on the classical theory of contract law. This therefore begs the question, whether such a balance between an application of a rigid system of rules, devoid of any reference to social context, and the altruistic, standard oriented norms, is possible or even desirable, in our law of contract.
