Question
Express Terms,Excluision Clauses & Implied Terms
In the Republic of Mirdita, Boule enters into a written contract to purchase a stereo system for his car from car stereo retailer, StretStereos Music for 15,000 vatu. The stereo system was installed by employees of StretStereos Music into his car. Whilst driving down the road with techno music blasting, the stereo system suddenly explodes and hits Boule in the face, causing him injury.
When Boule goes back to StretStereos to complain, the owner directs Boule's attention to a notice on the wall behind the customer counter that states:
"StretStereos accepts no responsibility whatsoever for faulty goods".
Boule was not aware of the notice at the time when he purchased the stereo from StretStereos. This notice was not incorporated into the contract that Boule signed when he purchased the stereo system.
Please advise Boule if he can sue StretStereos Music for damages or not.
