Question Four (4) [10 Marks Anna Tambo is a 48 year old wife and mother of 3 children, all fathered by her husband Mr Tambo. Anna and her husband reside in a rural village in one of the regions in Namibia. The two spouses were married by customary union in in 1986. Mrs Anna has committed adultery with one Mr Peter. Anna's husband is furious and demands compensation. He has approached the Magistrate's Court to resolve this matter and furthermore seeks a divorce from the said court. Set out as to whether Mr Tambo has approached the correct court to hear his sentiment, if not, suggest the correct court of first instance. Set out which piece of legislation would apply here and why. Presume the appropriate sentence on Mrs Tambo.
