Tenants: Joshua and Katy Smith

Property: 21 Trust Drive, Cannon Hill, QLD, 4071.

Rent: $400 p/wk.

The Facts:

The rental bond of $1,600.00 was held by the Residential Tenancies Authority (RTA) under Bond Number 5697767-X

The tenants vacated the property 25th January 2021

At the time of vacating there were rent owing, water invoice outstanding and cleaning invoice which the owner was seeking compensation for

The tenants did not agree to the agents claim and submitted a bond claim to the RTA for the entire bond to be released to them

The claim was the subject of a conciliation at the RTA however the matter was unresolved, and the RTA issued a Notice of Unresolved Dispute M419839

The agent on behalf of the lessor made an application as a minor civil dispute seeking an order that the Respondents pay the Applicant $1600.00. The claim was supported by the rental ledger, paid invoice for cleaning and oral submissions. The claim was broken down and supported by written material as follows:

Rent arrears $800.00

Water usage charges $372.00

Cleaning $428.00

QCAT hearing took place Wednesday 7th April 2021.

Outcome of hearing

The tribunal hearing has come to an end and you have been given the following orders;

The tribunal was satisfied that there were rent arrears in the sum claimed

The tribunal was satisfied that the tenant is liable for the water usage charges and this matter was not challenged by the tenant

A comparison of the comments which appear in the Entry Condition Report with the comments which appear in the Exit Condition Report bring the tribunal to the conclusion they were satisfied that the tenant is responsible to reimburse the landlord the total cost of cleaning the invoice

The tribunal directed the RTA to pay the Applicant by 4.00 pm on 22 April 2021 the sum of $1600.00.
