It is aware that if Ravy commences proceedings in the County Court, it has little prospect of successfully contesting liability and is likely to be ordered to repay Ravy at least the escrow money and the service fee. However, it is not prepared to pay the full amount that Ravy claims. It is also aware that it faces the prospect of having to pay Ravy's legal costs once proceedings are commenced. 1(a) Discuss the usual rule on costs between parties to a court proceeding, the basis or bases on which the court may order a party to pay the costs of another party in a proceeding and the usual basis for such costs. 6 marks 1(b ) Further, discuss a strategy by which ACU may be able to avoid having to pay Ravy's costs and/or obtain a costs order in its favour, should Ravy decide to commence proceedings in the County Court . 6 marks
