Question ( Representations/ Terms) W owned a 1999 Ford car (which had the same appearance as the earlier 1994 model of that car). It had several previous owners. He purchased a new vehicle from Cheeky Motors Pty Ltd (CM) (an experienced dealer in motor vehicles) and traded in his old car as part payment. W honestly believed his car was a 1999 model and informed CM that it was made in 1999 which was the date shown in the log book when first registered. W received $1,000 on the trade. Later, CM found that the Ford was really a 1994 model and worth much less. They allege W's representation was a term in the contract and want to sue W for breach of contract and claim the difference in value between the two cars. Discuss the legal possibilities.
