(a)Renee, reads a catalogue in her post-box advertising a jacket for $20 and turns up to the store wanting to buy the jacket. The jacket is displayed in a shop window with a price tag of $20.00. Renee enters the shop and tells the shop assistant that she will buy the jacket for $20.00. The shop assistant refuses to sell the jacket at that price, explaining that the price tag should read $40.00. Renee is uncertain whether the jacket is too expensive. The store informs her that she can take one week to decide. When Renee returns, she is informed that the jacket has been sold to another customer.

Advise Renee whether there is a contract between her and the store.

(b)Tania offers Francis gardening work for $10.00 per hour. Francis says she wants

$15.00 per hour. Tania says: "I'll give you $12.00". Francis responds by saying: "Give me $15.00 and I'll do some landscaping work for you as well." Tania says: "OK but what kind of landscaping do you do?" "I do general bed maintenance, pruning and 'land protect and feed' services" replied Francis.

Tania replies, " Could you please supply irrigation start up services as well? If so, you can start on Monday next week." Francis looks doubtful. "Come on," says Tania "If I don't hear from you by 5pm tomorrow, I'll take it that you're OK with this arrangement and will expect you bright and early Monday morning."

Is there a contract?

(c) Michael owns a financial services firm. To encourage his staff to work harder, he sends an email to all staff stating the following: 'Any staff member who introduces five new clients by the end of August will be given a $500 complimentary gift card paid for by me'. Vincent works in Michael's firm as a Marketing Executive and although he receives Michael's email, he is too busy to read it and archives it in his mailbox. Before the end of August, Vincent introduces five friends as new clients. Subsequently, he reads Michael's letter and asks for the complimentary gift card. Michael refuses.

Is Vincent legally entitled to the complimentary gift card?

Would your answer be different if Vincent had read the email before introducing the new clients?

(d)Jenny buys a $2.00 lottery ticket every week with her tenant, Gavin. They take turns to buy the ticket and both contribute to the purchase of each ticket. Last week Jenny bought a ticket and scratched a winning amount of $500.00. She refuses to share half of the winnings with Garry. Advise Jenny.
