Sean is a Building Design student at WSU.During his time at the campus he is faced with a variety of situations which are recorded in each of the separate scenarios below.Sean wants your advice as to whether a contract has been formed in each of the scenarios.
i.Whilst at a comic bookshop Sean sees a comic book on a promotional table marked "All Items $10.00".Sean thought it was quite a bargain and so went to the cash register and handed the cashier $10.00.The cashier told Sean that the book was $50.00 and that he could not have the book for $10.00.
ii.Sean's sister Monica is concerned about his marks, and promised that she would give him $300.00 if he stopped reading comic books, started attending all his Enterprise Law ZOOM lectures and tutorials and achieved a Distinction in his next assignment.Sean worked hard all term attending all classes and achieved a Distinction in his assignment.When he asked Monica for the $300 she refused to pay.
iii.Sam, a construction student at WSU, has a Macbook Air that Sean has shown an interest in as he desperately needs a laptop to do his assignment. Sean asked, "Does this laptop come with a good camera and speakers?" Sam replied, "Yes it does. I am prepared to sell it to you if you give me $1500.00 right now".Sean replies, "You've got a deal, but I will need to pay you in weekly instalments of $300.00". Sam states, "If I don't hear from you in 3 days' time, I assume that you are keen to purchase the laptop." The next day Sean finds out that Sam sold the laptop to his friend Lucia for $1200.00. He approaches Sam and says, "We had a deal, you owe me the laptop".
iv.Sean is in a hurry to get to his casual employment on time. Lately, due to study commitments he has been late to work on several occasions and has been warned by his supervisor if this happens again he will lose his job.He gets into his car and notices that the car engine will not start as he left the car lights on and the battery went flat.Tania, a student at the same campus offered to drive Sean to work and Sean accepted.When Sean got to work on time, he was so grateful that he promised Tania he would buy her a ticket for an opera performance.Sean did not give Tania the complimentary opera performance ticket and when Tania claimed he had to, he told Tania that he is not obliged to give it to her.
